Review Cromwell Ordinance 2023-1
Unified Development Ordinance: All items below have the option for a vote to move forward to a public hearing.
Review the current UDO for language clarity and areas of conflict within the UDO from 2012-2023.
Article 5.14 DW-01: General Driveway Standards adjusting and adding language under A. Project Applicability numbered 1-3 as follows.
1. Residential Limits (Private):
a) Access to three (3) or fewer lots or access to three (3) or fewer dwelling sites be established as a private drive with fifty (50) feet of right-of-way, to account for the health, safety, and welfare of the residents and shall include a recorded private drive maintenance agreement.
b) Access to four (4) and up to six (6) or fewer single-family lots or access to six (6) or fewer dwelling sites shall be established as a private street with fifty (50) feet of right-of-way (or as an easement or common area with street maintenance agreement). Professional Engineer (PE) or Professional Surveyor (PS) stamped plans are required and should account for the health, safety, and welfare of the residents. Minimum required information includes, but is not limited to typical roadway section, roadway width, alignment, and profile.
2. Residential Limits (Public): Access to four (4) or more single-family lots or access to four (4) or more dwelling sites shall be established as a public street with sixty (60) feet of right-of-way and shall meet the applicable standards within the Noble County Road Acceptance Specifications.
3. Non-residential Limits: Access to four (4) or more non-residential lots that convey over 2,000 vehicles on average per day shall be established as a public or private street and meet the applicable standards within the Noble County Road Acceptance Specifications.
Modifying Article 7.21 Private Street Standards to request and include certified plans by a licensed engineer.
Contract:
Review of the new proposed contract from Hometown Initiatives, LLC to properly incorporate the residential and commercial Solar into the Unified Development Ordinance. Additional expense request to the County Commissioners on Monday, March 27, 2023, at 10:00 am in the Commissioners Room at 109 N York Street. If approved will move forward to County Council.
